Agreement
These Terms of Service ("Terms") govern your use of restaurantleads.org and the lead data, dashboard, exports and API we provide (the "Service"). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of a company, you confirm you have authority to bind that company.
The Service
We provide information about restaurants that are expected to open, compiled from public records and other sources. Plans differ in the number of leads delivered per month, timing of delivery, and access to the API, as described on our pricing page. We may change the sources, markets and features of the Service over time.
Accounts
You sign in with a Google account and are responsible for all activity under your account, including use of any API key issued to it. Keep your API key confidential and tell us promptly if you believe it has been compromised.
Subscriptions and billing
Subscriptions are billed monthly in advance through Stripe and renew automatically until cancelled. You can change or cancel your plan at any time from the billing page; the change takes effect at the end of the current billing period and you keep access until then. Fees are non-refundable except where required by law. We may change prices with at least 30 days notice by email; the new price applies from your next renewal after the notice period.
Permitted use
Leads are licensed to you, not sold, for use by your business to market your own products and services. You may not:
- resell, sublicense, publish or otherwise redistribute the lead data, in whole or in part, to any third party,
- share your account or API key with anyone outside your organization,
- scrape, crawl or bulk-download the Service other than through the CSV export and API we provide,
- use the data to build a competing lead or data product,
- use the data in violation of any law.
On termination of your subscription you may keep leads you already downloaded, subject to the restrictions above.
Your responsibilities when contacting leads
You are solely responsible for how you contact the businesses and people in the lead data. You must comply with all applicable laws, including the Telephone Consumer Protection Act, the CAN-SPAM Act, Do-Not-Call rules and any state or local marketing laws, and honor any opt-out requests you receive.
Data accuracy
We work to verify leads against their source records, but public records can be incomplete, outdated or wrong, and opening plans change. The Service is provided "as is" and "as available". We do not guarantee the accuracy, completeness or timeliness of any lead, the number of leads available in any market or period, or that any lead will result in a sale.
Exclusive access
Enterprise exclusive access arrangements, where we agree not to sell leads in a given category and area to anyone else, are governed by a separate written agreement that sets out the scope, term and price.
Intellectual property
The Service, including its software, design and the compilation and arrangement of the lead data, is owned by RestaurantLeads and protected by copyright and other laws. These Terms do not grant you any rights except the limited license described above.
Termination
We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that could harm us or others. You may stop using the Service and cancel at any time. Sections on permitted use, data accuracy, limitation of liability and governing law survive termination.
Limitation of liability
To the fullest extent permitted by law, RestaurantLeads will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising out of or related to the Service. Our total liability for any claim will not exceed the amount you paid us in the three months before the claim arose.
Indemnity
You agree to defend and indemnify RestaurantLeads against any claim arising from your use of the lead data or the Service in breach of these Terms or applicable law, including claims relating to your outreach to leads.
Governing law
These Terms are governed by the laws of the United States and the state in which RestaurantLeads is established, without regard to conflict of law rules. Any dispute will be resolved in the courts located there.
Changes
We may update these Terms from time to time. We will post the new version here and update the date above, and for material changes we will email account holders. Continued use after a change means you accept the updated Terms.
